Position Description:

We are seeking a highly skilled and experienced Compliance Attorney with a strong background in healthcare fraud and abuse laws and healthcare provider engagement including speaker programs, promotional review, payment transparency and reimbursement strategies. As part of the legal team, the Compliance Attorney will work closely with key stakeholders in legal, regulatory, and business functions to maintain a robust compliance program and mitigate risks.

 

Responsibilities:

  •  Legal Counsel regarding federal and state regulations affecting the healthcare industry. Advise on risk mitigation strategies to ensure compliance across various business operations. Handle conflict of interest, sponsorship, gift and similar issues.
  • Compliance Program Management: Assist in the development, implementation, and maintenance of the company’s healthcare compliance program. Lead compliance audits and risk assessments and conduct the company’s enterprise risk management activities. Collaborate with cross-functional teams (e.g., regulatory, sales, marketing) to develop and implement policies and procedures related to compliance.
  • Speaker Programs and Promotional Activities: Provide legal guidance on speaker programs, promotional activities, and healthcare professional engagements, ensuring they are compliant with federal and state regulations. Advise on fair market value assessments, transparency reporting, including Open Payments (Sunshine Act) requirements.
  • Reimbursement and Payment Practices: Counsel the business on healthcare reimbursement practices and sales activities, including information regarding coding, coverage, and payments.
  • Training and Education: Develop and conduct training programs for employees on healthcare compliance topics. Ensure the company stays informed of legal and regulatory changes affecting the healthcare industry.
  • Investigations and Enforcement: Conduct internal investigations related to potential legal or regulatory violations. Respond to government inquiries, audits and investigations, and manage related enforcement actions.
  • Policy and Procedure Development: Draft and update corporate policies and procedures to ensure compliance with healthcare regulations.
  • Monitor Regulatory Changes: Stay abreast of evolving healthcare laws and regulations at both the federal and state level, and provide proactive legal advice to ensure ongoing compliance. Advise senior management on regulatory trends and their potential impact on business operations.

 

Requirements/Qualifications

  • Juris Doctor (JD) from an accredited law school and active bar membership in good standing.
  • 7+ years of legal experience with a focus on healthcare fraud and abuse, healthcare provider engagements, and reimbursement in a medical device company.
  • In-depth knowledge of healthcare fraud and abuse laws, including the Anti-Kickback Statute and False Claims Act and related regulations.
  • Proven experience providing legal guidance on speaker programs, promotional activities, and healthcare reimbursement matters.
  • Demonstrated experience with compliance program management, audits, and risk assessments.
  • Strong research, analytical, and problem-solving skills with the ability to interpret complex legal and regulatory issues.
  • Excellent communication and interpersonal skills with the ability to effectively collaborate with cross-functional teams.

 

Preferred Skills

  • Prior in-house counsel experience preferred
  • Privacy law background and experience with data use rights and obligations would be helpful
  • Experience implementing and using a compliance software solution preferred
  • Experience working with government agencies (e.g., Office of Inspector General (OIG), or the Centers for Medicare & Medicaid Services (CMS)) is a plus

 

A candidate’s final salary offer will be based on their skills, education, work location and experience, and thus it may differ from the posted range. Compensation may also include bonuses consistent with Ceribell’s corporate compensation plan. $265,000 - $320,000 USD
