Bloom Energy, a solid oxide fuel cell company, is looking for an Assistant General Counsel, Corporate, Compliance, and Ethics, to help create an innovative, world-class compliance and ethics program. This individual should be a dynamic professional who is looking for a rewarding future in one of today’s most exciting technologies.

The Assistant General Counsel, Corporate, Compliance, and Ethics will be a member of the Legal Department who will primarily support the global risk, compliance, and ethics team. The individual contributor will work closely with all business areas, including finance, sales, marketing, business development, manufacturing, service, and supply chain. The role includes a broad spectrum of compliance and ethics responsibilities, including assessing risk, developing policies and procedures, conducting training, performing compliance monitoring and testing activities, administering our third party risk management program, and leading investigations. There will be a strong emphasis on third party risk management and our anti-bribery and anti-corruption program.

Role and Responsibilities:

  • Understand Bloom Energy’s global business operations and advise business leadership on risk mitigation activities under the global compliance and ethics program.
  • Drive timely and effective execution of compliance and regulatory risk assessments.
  • Drive collaboration and build relationships between the risk, compliance, and ethics team and various stakeholders within Bloom Energy and serve as a champion of the compliance and ethics program.
  • Support the development and execution of compliance-related training and communication programs.
  • Lead the third party risk management program.
  • Support compliance with global privacy statutes and regulations, including GDPR, CCPA, CPRA, HIPAA, etc.
  • Lead investigations and monitor resulting remediation actions.
  • Review trade sanctions and adverse media alerts.
  • Develop and update compliance and ethics policies and procedures.
  • Conduct monitoring and testing activities.
  • Review policy exceptions and approval requests.
  • Assist Legal and Finance with SEC requirements and filings, including Forms 10-K, 10-Q, the proxy statement and other miscellaneous SEC filings.
  • Maintain regulatory obligations matrices.
  • Participate in special projects and broad company initiatives.
  • Contribute to the improvement of the risk, compliance and ethics function.
  • Work cross-functionally with Internal Audit, Human Resources, Information Technology, Finance, Sales, Operations, Supply Chain, Installation Group, Service, Products, Marketing, and other internal stakeholders.
  • Perform other tasks as assigned.

Skills and Experience:

  • 15+ years of broad compliance and ethics experience, SEC and DOJ experience preferred.
  • JD required with active Bar membership, CCEP, CCEP-I and/or CRCM preferred
  • In-depth knowledge of the DOJ Evaluation of Corporate Compliance Programs and global third party risk management experience required
  • Knowledge and experience with FCPA and other anti-bribery and corruption laws
  • Knowledge and experience with privacy regulations, including GDPR and CCPA / CPRA
  • Strong Microsoft Office skills
  • Strong project management skills
  • Ability to adapt in a rapidly changing environment
  • Ability to work effectively with minimal supervision
  • Has experience and knowledge of best practices
  • Enjoys problem-solving and developing new processes
  • Understanding of trade sanctions screening best practices.
