Department Overview

Sr. Privacy Counsel will serve as a key member of the Global Data Protection - Enterprise team at Motorola Solutions, Inc. ("MSI") and will provide legal counsel to MSI stakeholders globally and drive continuous maturation of the privacy program. The Global Data Protection - Enterprise team is part of the MSI legal team within the Ethics & Compliance function. In this role, support will be provided to the enterprise functions within the organization e.g. Procurement, Marketing, HR, Enterprise Information Security, Sales, legal, Global Data Protection – Products, Audit, Government Affairs and other compliance operations etc. as needed. Must be able to work autonomously and determine objectives of on-going assignments. Regularly briefs manager on work and escalates complex matters or decisions that may pose legal, financial and/or reputational risk . While this role will report to the Sr. Director, Data Protection Officer Data Protection – Enterprise, he/she will also work closely and collaboratively across various organizations within the company globally.


Job Description

Responsibilities:

  • Provide legal guidance and counsel on the interpretation or application of the data protection laws and regulations globally for procurement, marketing, sales, HR, Enterprise Information Security and other functional and business areas.  Manage/ address global data privacy matters and direct efforts of local operations as necessary to resolve issues and/or implement corrective actions.
  • Assist with maintaining and monitoring MSI Binding Corporate Rules. Assists in drafting privacy policies and procedures and monitoring compliance with other privacy and security policies and standards across the organization;
  • Assist in fostering a culture of data protection within the organization, through training and awareness and implementing essential elements of privacy by design and default.  Support the Privacy and Data Security Committee programs and activities as needed. Conduct / participate in both external and internal audits to mitigate risks.
  • Work with Information Security and other cross-functional teams to prioritize and understand data security initiatives and to support legal compliance. Serves as privacy Enterprise Information Security expert. Maintains records of the company’s data privacy and cybersecurity compliance efforts.  Provide management reports of global data protection landscape (internal & external);
  • Support the development, deployment and maintenance of incident response procedures and the privacy runbook. Participate alongside information security and other teams in responding to data privacy and security incidents;
  • Conduct and supervise data privacy risk assessments for business operations globally and coordinate with internal audit and information security teams as required;
  • Support efforts of the Data Protection Office to ensure an evergreen data asset inventory, including data flows and data mapping;
  • Draft and / or review contract language relating to privacy and security clauses to ensure alignment to company security standards and minimize data privacy and security risks. As part of the review, work closely with procurement and procurement legal teams to assist with vendor / business process privacy risk assessments;
  • Review and provide guidance on data processing agreements and standard contractual clauses, including transfer impact assessments;
  • Support the process for the consistent use of data privacy impact assessment where necessitated by business process / supplier updates;
  • Participate in enterprise risk management efforts and meetings as needed.
  • Support Government Affairs review and impact analysis of upcoming privacy and security laws and frameworks.
  • Support DPO with internal and external queries as necessary in relation to data protection processes, subject access rights, and right to be forgotten and other data subject rights globally.
  • Support and coordinate 
  • Engage with privacy regulators as may be required. with other privacy counsels on M&A transactions as privacy subject matter expert from due diligence through integration (as needed);
  • Manage and evolve global data use and privacy policies and strategies in coordination with teams based around the world, responding to global legal changes and providing proactive thought leadership on questions for which there is no developed law
  • Maintain expertise in global data privacy laws, frameworks and advise on impact to Motorola Solutions e.g. HIPAA, GDPR, CCPA, CPRA, CPA, PDPA, LGPD, VCDPA NIST, EU AI Act etc.

 

Required Skills:

  • Excellent analytical, Interpersonal and communication skills (written and verbal)
  • Experience with managing, supervising and providing coaching within a team environment.
  • Experience applying knowledge of multidisciplinary business principles and practices to achieve success
  • Experience dealing with marketing, procurement and technical information security related issues.
  • Experience dealing with incident response
  • Excellent negotiation, problem solving, consultation, and analytical skills
  • Well organized, detail oriented and adept in a fast paced environment.
  • Experience with legal policies and procedures.  Demonstrated ability to identify potential legal issues.  Ability to approach issues with a sense of pragmatism and flexibility to recommend solutions that enable our company’s success while protecting its legacy.
  • Required to work in the highest level of ethics and discretion
  • Experience providing practical advice and counsel to enterprise clients
  • Experience with privacy management platforms e.g. Trustarc, OneTrust, RadarFirst  etc.
  • Privacy, information security experience required
  • Excellent critical thinking and creative problem solving skills.
  • Excellent communication skills with experience presenting solutions to executive level management
  • A passion to engage deeply with complex data use and global privacy issues

Basic Requirements

  • Juris Doctorate Degree from an ABA accredited law school
  • Active member of a State Bar Association and authorization to practice in at least one US jurisdiction
  • 7+ years of experience as an attorney in security, data privacy and compliance for private law firm and/or as in-house counsel; direct experience advising and counseling on global privacy and security issues
  • CIPP certifications or willing to work towards a professional certification the IAPP (CIPP/ US, CIPP/E, CIPT strongly preferred)
  • Legal authorization to work in the U.S. indefinitely is required. Employer work permit sponsorship is not available for this position.
