About the team and role: 

Dave is looking for an experienced fintech consumer finance product and regulatory attorney, with practical background in neobanking products,  specifically focused on consumer deposit accounts, payments and payment processing, including NACHA expertise, bank operations, and BSA/AML/fraud management, along with  transactional experience. The role will advise on existing and new product strategies for banking, lending, neobanking and subscriptions products. 

 

What you’ll do: 

  • Partner with cross-functional business teams, such as product, design, engineering, fraud, risk operations and compliance, to develop payment related product launches and back-end enhancements to existing banking, lending, and subscription products.

  • Advise on, review, draft, and assist negotiating strategic transactions with fintechs, e-commerce players and customer-facing technology companies in support of new products and partnerships.

  • Understand the technology and services that the payments business areas deliver to to support bank partner products, and apply complex financial regulations to help manage legal risks.

  • Support innovation across Dave, including emerging payment technologies and payments related features on our mobile app, and sharing and collection of data to support fraud prevention.

  • Conduct legal research and analysis on emerging fintech trends and digital assets and oversee state and federal regulatory monitoring programs and related legal inventories. 

  • Advise on the overall payments strategy, advocacy and industry consortia engagements.

  • Be the subject matter expert on banking as a service (BaaS)  partnerships, and payment processors and associations and federal and state privacy environments.

  • Independently support servicing processes, including escalated complaints, credit bureau reporting, bankruptcy, liens, subpoena, garnishments, escheatment and Powers of Attorney.

  • Advise on legal issues related to AML, CIP and Fraud matters as the primary legal support for the risk operation teams.

  • Strategize business options for implementing any new or changed federal or state requirements relevant to the business areas supported.

  • Help establish efficient and effective processes within Legal and compliance (leveraging automation and AI);  develop and implement a strategy on how to best leverage and manage outside counsel vs. internal resources for maximum impact.

  • Provide forward-looking, practical, creative, and strategic legal advice on a broad range of issues in a fast-paced, high-growth environment.

 

What you’ll need: 

  • 7+ years of legal / regulatory roles in consumer financial services and/or fintech with specific expertise in managing state licensing laws and requirements and building state  requirements inventory.

  • J.D. degree and a state bar member in good standing, with fin tech banking experience.

  • Experience with payments and banking industry legal issues and applicable compliance requirements and regulations, including NACHA Rules, card network rules, Regulation E, Bank Secrecy Act / anti-money laundering rules and state money transmission services regulation

  • Significant expertise in federal laws and regulations such as EFTA/Reg E, FCRA/FACTA, SCRA/MLA, AML/BSA, FDCPA, NACHA, FDIC insurance, and GLBA/Reg P.

  • Understanding of banking and lending operations, along with an ability to balance legal risks with business strategy in a creative and flexible manner.

  • Strong communication skills, ability to independently lead and influence key stakeholders in a fast-paced environment with competing priorities.  

  • Ability to thrive in a fast-paced environment and be organized, detail-oriented, self-starting, resourceful, and flexible.

  • Business judgment and ability to assess legal risk while providing practical advice in ambiguous and changing scenarios.

  • Ability to act as a legal advisor and partner, providing insight and advice across business units and to other internal stakeholders.

  • A team-player mindset with the ability to work collaboratively across various functions and with colleagues at all levels.

  • Curiosity and enthusiasm with a drive to take ownership of projects, build relationships cross-functionally and work on cutting-edge legal issues.
