ADI is seeking an experienced lawyer to serve as Senior Counsel, Data Privacy that will report directly to the Chief Compliance Officer. This role will be based in either San Jose, California or Wilmington, Massachusetts. This role will work with global, cross-functional teams of in-house lawyers, paralegals and other legal and risk specialists and support staff.

Primary Duties And Responsibilities

  • Advise on all aspects of global, US and state privacy laws and regulations, including data protection, retention, security and breach rules.
  • Create and drive risk-based enterprise-wide data privacy strategy to help ensure appropriate collection, handling and use of data related to do-it-yourself and professional customers, online advertising activities, electronic devices, and employees, as well as compliance with applicable laws.
  • Support in negotiation of privacy, information security and compliance terms in technology, vendor, and service provider contracts.
  • Conduct privacy impact analyses, risk assessments and due diligence for existing and new third parties to address privacy and corporate compliance risks and legal requirements.
  • Advise and collaborate with data analytics, information security and business teams on artificial intelligence (AI) governance, use and risk mitigation.
  • Monitor and assess legislative, regulatory, and enforcement developments in privacy law and corporate compliance matters globally.
  • Lead California (CCPA/CPRA) and other US state privacy law compliance efforts, including analyzing applicability of relevant statutes to certain third parties.
  • Partner with the information security team on handling data security incidents/events and represent the Legal Department on incident response and readiness.
  • The ideal candidate would be able to advise on other compliance areas beyond data privacy, such as anti-bribery/anti-corruption, trade and economic sanctions and state and local-level retail regulatory matters; create and implement risk assessments re same; help drive closure of potential compliance gaps.
  • Conduct or oversee internal investigations related to data privacy or other compliance areas.
  • Oversee outside counsel within allotted budget.
  • Ensure data-related policies are in place and updated regularly and in compliance with applicable laws and regulations.

Experience And Skills

  • Proven track record of leadership, cross-functional collaboration and successful management of multiple stakeholders, including senior executives.
  • Appetite and aptitude for, nimbleness, aptitude to succeed by applying technical legal skills across subject matters.
  • Excellent business-oriented judgment and the ability to analyze problems, propose resolutions, and provide advice that is creative, practical and legally acceptable, considering the needs and objectives of the business.
  • Exceptional business partnership skills, including written and verbal communication skills.
  • Highest standards of ethics and professional integrity.

Qualifications

  • Strong academic credentials, including a J.D. degree from an accredited law school, and membership in good standing in at least one state bar, plus 10+ years of privacy law and corporate compliance.
  • Hands-on experience interacting directly with privacy and data protection regulators and regulators of US public companies.
  • Ability to develop and maintain collaborative relationships with peers and colleagues across the global organization, as well as with internal and external clients.
  • Experience working in a fast-paced environment, with a history of advising in real-time in meetings, including to executive leadership team, providing accurate guidance and pragmatic solutions.
  • Strong analytical, prioritizing, interpersonal, problem-solving, presentation, budgeting, project management (from conception to completion) and planning skills.
  • Fluency in English required; business proficiency in other European languages is a plus.
  • Strong verbal and written communication skills (including analysis, interpretation, and reasoning) and executive presence.
  • Ability to travel, as needed, both in region and internationally (up to 25%).
  • High degree of systems proficiency (including MS Office Suite, Outlook and Internet applications).
  • Experience in developing, implementing, and maintaining data-related policies and procedures.
  • Experience in managing data breaches and other security incidents.
  • Certifications such as Certified Information Privacy Professional (CIPP/US, CIPP/E) are desirable.
  • Experience with artificial intelligence at the intersection with data protection is a plus.
