Summary:

Viavi Solutions is seeking exceptional candidates for the position of Director, Global Trade.

VIAVI empowers Service Providers, network equipment manufacturers and IT organizations around the world to manage network lifecycle for complex 5G and Fiber networks with intuitive instruments, systems and technologies; and our expertise in light management and optical coatings help protect the world's bank notes from counterfeiters and enables advanced technologies such as 3D sensing. The majority of VIAVI’s business is international and the Global Trade Director is an essential leadership position and contributor to the company’s growth and success.

Duties & Responsibilities:

Reporting to the General Counsel, the Global Trade Director leads the Trade team and enables VIAVI’s international market access for product, software, technology and services (“Product’) by providing oversight and guidance on all regulatory requirements associated with the international movement of VIAVI’s Product.  These regulatory requirements include U.S. export controls and Customs processes as well as those of many foreign countries.  The Global Trade Director provides strategic guidance to senior management, the Trade team, the legal department and other stakeholders throughout the company enabling and facilitating good business while ensuring VIAVI trade compliance.

 

Responsibilities

The Trade Director’s success is achieved through:

  • Developing a culture of trade compliance and cultivating a strong organizational awareness of the U.S. and international regulatory environment and anticipating and reporting potential changes which might affect VIAVI.
  • Mentoring and enabling a team of strong Trade professionals.
  • Building collaborative relationships with VIAVI’s business unit leaders through understanding their business goals and objectives and integrating Trade controls into their operations.
  • Understanding and utilizing technology to develop scalable, integrated and effective Trade controls.
  • Contributing to the company’s bottom line by identifying and implementing all possible Trade cost minimization.
  • Optimizing the trade compliance support model by developing ongoing, creative approaches to increase company-wide Trade awareness and education throughout VIAVI’s global employee population.

 

Pre-Requisites / Skills / Experience Requirements:

Qualifications

 

The optimal candidate will possess the following qualifications.

- 10+ years of increasing leadership positions within the Global Trade discipline including personnel management with strong knowledge of:

​​​​​the EAR, ITAR & OFAC regulations.

  • The export classification processes with respect to hardware, software and technology.
  • EAR, ITAR and UK export licensing requirements.
  • U.S. and international Customs regulations including HTS classifi cation, country of origin determination, preferential Trade agreements, etc.
  • how to integrate these regulations into a company’s day-to-day operations.

- The ability to engage collaboratively with direct reports, legal department colleagues, VIAVI stakeholders and regulatory officials and be viewed as a trusted, engaging and responsive partner.

- A history of developing effective and scalable Trade controls.

- Experience conducting Trade due diligence in mergers and acquisitions and identifying potential risk and making recommendations.

- Implementing and managing Global Trade Management Systems with full integration into the company’s ERP system.

- A record of identifying and implementing Trade cost-saving measures such as Drawback, Section 301 mitigation, 9801 and 9802, etc.

- The development and management of Trade audit strategies to minimize risk and improve operations.

- A history of promoting Trade awareness within the company including, but not limited to, the development and delivering of mandatory employee Trade training.

- Strong teamwork, communication and project management skills.

- Experience in many of the following Trade programs: Importer Self-Assessment (ISA), Customs-Trade Partnership Against Terrorism (C-TPAT), Economic Authorized Operator (AEO), etc.

A relevant university degree, Trade professional designation(s), previous participation in Trade industry or government forums as well as a sense of humor would be considered an asset.  Juris Doctor degree is also an asset although not required.
