The demand for DEI specialists and lawyers has significantly increased among Fortune 500 companies following the Supreme Court's review of university admissions processes.

Surge in Demand for DEI Lawyers Amid Corporate Diversity Debates

In recent times, the discourse surrounding corporate diversity, equity, and inclusion (DEI) programs has escalated to unprecedented levels, resulting in a surge in demand for specialists in the field. Companies are grappling with the need to navigate potential legal challenges while fostering inclusive workplaces. Let’s delve into the changing landscape and the critical role of DEI lawyers.

Escalating Demand

Specialists in DEI have witnessed a significant uptick in inquiries from Fortune 500 companies since June 2023. This surge follows a pivotal Supreme Court decision banning the use of race in university admissions

Conservative activists have seized this opportunity to challenge diversity programs across corporate America. Kenji Yoshino, constitutional law professor at New York University, reports receiving calls from potential clients every week, having presented to approximately 75 companies since the previous summer. 

Yoshino said “the appetite for this is just going through the roof. It’s exponential and there’s no end in sight.”

Legal Consultations and Audits

Law firms and consultancies specializing in workplace diversity are experiencing a flurry of requests for audits and legal counsel. Companies seek to assess and potentially revise their DEI efforts. Jason Schwartz, overseeing a DEI task force at the law firm Gibson Dunn, highlights the substantial demand for services related to auditing DEI efforts, board diversity, and risk assessment. 

“Lots of clients are wanting to do audits, review all DEI efforts, board diversity, socially conscious investing to assess risk and figure out what — if any — changes they want to make,” Schwartz said. “There is a never-ending tide of stuff. These legal professionals play a crucial role in ensuring compliance with evolving legal standards.”

Schwartz underlined that at the moment, there is a need for a lot of creativity and tolerance for risk. “All of the banks I have been talking to, their view is we are not going to overreact and abandon our programs. ‘We don’t want this place to look like it did in 1950. We want to do it in a lawful way but we’re not going to run away from it’.”

Communication Strategies

Public relations professionals are also in high demand. PR expert Lindsay Singleton advises clients on communication strategies concerning DEI. Companies recognize the importance of transparent and legally sound messaging in navigating the current landscape. As the furor over corporate diversity, equity, and inclusion programs intensifies, specialists on this topic find themselves busier than ever.

“Companies are revisiting their DEI programs and looking at them with legal to figure out: how do we protect ourselves, how do we talk about it?” said Singleton. “There’s a realization that whatever you say to an internal audience is going to be shared with external audiences.”

Backlash and Uncertainty

The intensifying backlash against DEI initiatives, fueled by conservative groups and influential figures, has led to increased legal scrutiny. Companies are now grappling with the risk of litigation while striving to foster inclusive workplaces. Despite the uncertain legislative landscape, many remain committed to innovative solutions for navigating the complexities of DEI initiatives.

The surge in demand for DEI lawyers reflects the critical role they play in shaping corporate policies, promoting diversity, and ensuring legal compliance. As the conversation around DEI continues, these legal professionals will remain at the forefront, advocating for a more inclusive and equitable business environment.
